1. Acceptance of Terms

By accessing www.certisetu.com, submitting our guidance form, or messaging us on WhatsApp ("Services"), you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Services. These terms constitute an electronic record under India's Information Technology Act, 2000, and do not require a physical or digital signature.

2. About CertiSetu and Our Service

CertiSetu is an independent private platform, not a government agency, department, or portal. We are not affiliated with, endorsed by, or acting on behalf of the Government of Uttar Pradesh or the Government of India.

Current stage: Right now, CertiSetu provides free guidance only — helping you understand eligibility, required documents, and the application process for the UP Domicile, Income, Caste, and EWS certificates. We do not currently:

  • File or submit any government application on your behalf
  • Collect government fees or payments of any kind
  • Guarantee approval, rejection, or any specific processing time
  • Store or process identity documents, income proof, or caste proof

An application-filing service is planned for the future. When it launches, updated terms covering fees, refunds, and service-level commitments will apply, and we will notify users before those terms take effect.

3. Eligibility

To use our Services, you must be:

  • At least 18 years old, or a parent/guardian using the Services on behalf of a minor applicant
  • Legally competent to enter into a binding agreement under Indian law
  • A person seeking guidance on a certificate for yourself, a family member, or someone you are authorized to assist

4. Your Responsibilities

When you use our guidance form, WhatsApp number, or any other channel, you agree that:

  • All information you provide (name, contact details, district, certificate type, and any other details) is accurate and belongs to you or the person you're inquiring on behalf of
  • You will not submit false information, impersonate another person, or misuse the Services to harass or spam
  • You remain solely responsible for the accuracy of any application you file yourself or through the official e-District Portal — CertiSetu's guidance does not replace your own verification of current government requirements

5. Acceptable Use of the Website

You agree not to:

  • Scrape, crawl, or extract data from the website using automated tools without our written permission
  • Attempt to gain unauthorized access to our systems, forms, or any user's data
  • Reverse-engineer, decompile, or interfere with the website's normal operation
  • Use the Services for any unlawful purpose or in violation of applicable Indian law

We may suspend or restrict access for anyone who violates this section.

6. No Government Affiliation

We repeat this because it matters: CertiSetu is not a government portal, department, or agency. Official certificate applications are made through the applicable government system, such as the UP e-District Portal. We do not control, and are not responsible for, the government's handling, approval, rejection, or timeline for any application submitted there — whether or not you used our guidance beforehand.

7. Free Guidance — No Guarantee of Outcome

Our guidance is informational. It does not guarantee that your application will be approved, that you meet eligibility for a certificate or scheme, or that any specific processing time will be met. Government eligibility criteria, required documents, fees, and processing timelines can change. We make reasonable efforts to keep our guides current, but you should always confirm current requirements on the official e-District Portal or with your Tehsil/District office before applying.

8. Fees — Currently Free

CertiSetu does not charge any fee for the guidance we currently offer. We also do not collect any government application fee on your behalf. If a paid application-filing service is introduced in the future, fees will be clearly displayed before you pay, and a separate Refund Policy will apply to that service.

9. Third-Party and Government Portal Links

Our website and blog articles link to official government sources (such as edistrict.up.gov.in and india.gov.in) for your convenience. We do not control these external sites, are not responsible for their content, availability, or accuracy, and linking to them does not imply endorsement by those government bodies of CertiSetu.

10. Intellectual Property

The CertiSetu name, logo, website design, and original content (including our blog articles) are owned by CertiSetu or used under license. You may view and share our content for personal, non-commercial use. You may not copy, reproduce, republish, or redistribute our content or branding for commercial purposes without our prior written permission.

11. Data and Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which explains what we collect, why, and your rights under India's Digital Personal Data Protection Act, 2023. By using the Services, you also agree to that policy.

12. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including accuracy, completeness, fitness for a particular purpose, and uninterrupted availability of the website.

13. Limitation of Liability

To the maximum extent permitted under Indian law, CertiSetu shall not be liable for any indirect, incidental, or consequential loss arising from: delays, rejections, or errors by any government department or portal; inaccurate information you provide to us; your reliance on our guidance instead of verifying current official requirements; or any interruption or unavailability of the website. Since our current Services are provided free of charge, our aggregate liability for any claim relating to the free guidance service is limited to the amount you paid us for it — currently nil.

14. Indemnity

You agree to indemnify and hold CertiSetu harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Services, your violation of these terms, or false information you provide to us or submit to a government authority.

15. Termination

You may stop using the Services at any time. We may suspend or restrict access to anyone who violates these terms, misuses our forms, or engages in fraudulent or unlawful conduct, without prior notice where necessary to protect the Services or other users.

16. Changes to These Terms

We may update these Terms and Conditions from time to time, particularly as our Services expand (such as when the application-filing service launches). We will post the revised terms on this page with an updated "Last updated" date. For material changes, we will make reasonable efforts to notify users directly.

17. Governing Law and Dispute Resolution

These terms are governed by the laws of India. Before pursuing formal proceedings, we encourage you to first raise any dispute with us directly (Section 19) so we can try to resolve it informally within 30 days. Subject to that, these terms are subject to the exclusive jurisdiction of the courts at Varanasi, Uttar Pradesh.

18. Severability and Waiver

If any provision of these terms is found unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision at any time does not waive our right to enforce it later.
